Privacy Policy – art. 13 of Regulation (EU) 2016/679

Bioartis S.r.l. as Data Controller (“Data Controller”), its main objective is compliance with the applicable regulations on the protection of personal data and, for this reason, ensures the necessary requirements for its correct adaptation to the current legislation on the subject. In application of the European Regulation n. 679/2016 (GDPR), concerning the protection of individuals with regard to the processing of personal data, as well as the free circulation of such data and of Legislative Decree 196/2003 as amended by Legislative Decree 101/2018 we wish to inform you, as a User of the site, and therefore as an interested party, on the aspects relating to the processing of personal data that you provide us when you browse our website or use the services made available through the portal, as well as on your rights.

The treatments carried out by the Data Controller will be based, as required by the GDPR, on the principles of lawfulness, correctness, transparency, purpose limitation and retention, data minimization, accuracy, integrity and confidentiality.

The information that the Data Controller processes concerns:
The personal data (name, surname, date of birth, e-mail) voluntarily provided by you, on the occasion of your interactions with the site’s functions and the request for the services offered by the portal, such as – by way of example – those provided in the event registration on the website;
Navigation data, that is, those identification data implicit in the use of Internet communication protocols, acquired by the computer systems and software procedures used to consult the website. This is information that is not collected to be associated with identified interested parties, and therefore is treated anonymously;

No data belonging to the particular categories referred to in art. 9, i.e. those capable of revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, or genetic data, biometric data intended to uniquely identify a natural person, data relating to health or sexual life or sexual orientation of the person.
Furthermore, data relating to criminal convictions and offenses are not processed (Article 10 of the GDPR).

Purpose of the treatments
Bioartis S.r.l. processes your data for the following purposes:
Allow you to use the services made available by the Data Controller through the internet portal;
With reference to navigation data, exclusively for statistical purposes and in anonymous form, in relation to access and use of the site, for purposes of monitoring and improving the functioning and content of the portal itself;
To send you information and updates on the services offered and initiatives promoted by the Data Controller through online communication channels (marketing).

Nature of the provision of data and consequences of refusing to respond. Legal basis of the processing.
Taking into account the purposes of the processing as illustrated above, your personal data will be processed:
without your express consent for the purposes referred to in points a) and b) of the previous paragraph as they are connected to the services and activities you requested from the Data Controller (Article 6, letter b GDPR) through the use of the portal (navigation on the website, registration). The provision of data for these purposes is therefore necessary; it follows that any failure, partial or incorrect communication of data and information on your part may have, as a consequence, the impossibility for the Owner to perform the aforementioned services and activities.
Only with your specific and distinct consent (Article 7 of the GDPR), for the purposes referred to in letter c), of paragraph 3; if you decide not to give consent to the processing of data for these purposes, your browsing experience will not be precluded, nor the possibility of using the services offered through the website. We also inform you that at any time you can revoke your consent freely and free of charge through the methods indicated in the following par. 7.

Communication of personal data
Your personal data may be disclosed to the following categories of recipients or shared with them, within the scope of the purposes indicated above:
Data processors identified from time to time;
Persons, companies or professional firms that provide assistance and advice to the Data Controller in accounting, administrative, legal, tax, financial and credit recovery matters relating to the provision of the Services;
Subjects with whom it is necessary to interact for the provision of the Services (for example hosting providers);
Subjects delegated to carry out technical maintenance activities (including maintenance of network equipment and electronic communication networks);
Third parties, including international ones, who provide any services in favor of the Data Controller;
Companies and professionals used by the Data Controller in order to protect their own rights;
Subjects, entities or authorities to whom it is mandatory to communicate your personal data by virtue of legal provisions or orders of the authorities or to prevent and / or identify any fraudulent activity or abuse in the use of the site and the services offered by the Data Controller;
Persons authorized by the Data Controller to process personal data necessary to carry out activities strictly related to the services, who are committed to confidentiality or have an adequate legal obligation of confidentiality (e.g. employees or collaborators of Bioartis S.r.l.).

Retention period of personal data
The personal data processed for the purposes of using the services made available by the Data Controller through the internet portal will be kept for the time strictly necessary to achieve those same purposes and, subsequently, for the time provided for by the applicable reference legislation, or until it will be necessary to treat them by virtue of:
specific regulatory obligations;
provisions of public authorities;
obligations related to accounting;
any legal reasons, including those relating to the protection of one’s own interests (Article 2946 et seq. of the Civil Code).
The data processed for profiling and marketing purposes will be kept for 24 months.

Your rights
In relation to the data processed by the Data Controller, you may, at any time, exercise the following rights:
right of access, aimed at allowing you to know which data are processed and all information relating to the processing;
right of rectification, aimed at allowing you to request the modification of data as inaccurate or obsolete;
right to portability, aimed at allowing you to obtain a copy of the data that is processed, in a structured format, commonly used and readable by an automatic device, in order to facilitate a possible transfer of data to another Data Controller, other than MA .YOU.;
right to limit the processing, aimed at allowing you to be able to limit the processing of your data, provided that one of the hypotheses provided for by the applicable regulations occurs;
right to cancellation, aimed at allowing you to request data cancellation;
right to object, aimed at allowing you to request the cessation of data processing (eg the cessation of commercial communications);
right to lodge a complaint with the supervisory authority, aimed at allowing it to promote any reports, complaints or appeals to the Guarantor for the Protection of Personal Data.
